Guest Terms and Conditions Agreement



Guest/Cardholder must be a minimum of 24 years of Age



RESERVATION DEPOSIT/BALANCE DUE/CANCELLATION POLICY:

All reservations require a 50% deposit of the charge with the remainder due 30 days upon arrival. The guest understands that this deposit will be charged to their credit card upon the acceptance of the Terms & Conditions. Cancellation notices 30 days prior to arrival will be charged a fifty dollar ($50.00) cancellation fee. Any reservation cancelled within thirty (30) days of arrival will forfeit their deposit. We reserve the right to request the guest to secure either travel insurance or a security deposit of $1000.00, whichever the guest chooses. Travel Insurance is strongly suggested.
Travel Insurance: CSA Travel Protection Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for prepaid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection. Separate terms and conditions apply, read your Description of Coverage/Policy carefully and contact CSA at (866) 999-4018 with coverage questions.


RATES/SUBSITUTIONS

In case of sale or property damage, the property management company reserves the right to substitute another similar property for the one which has been booked. If no other property is available, Red Lodge Reservations reserves the right to return all monies paid. All rates are subject to change without notice (prior to booking).



OCCUPANCY:

The maximum number of guests per property must not exceed the posted capacity on the Red Lodge Reservation website. Over-crowding violates local health codes and fire ordinances, and is considered grounds for IMMEDIATE eviction from the property, with the guests’ forfeiture of any and all monies paid. If a house is found to be over occupancy we reserve the right to charge $100 per person over occupancy, per day if guests are not evicted. Use of premises shall not be such to disturb or offend neighbors or residents. We ask that a 10pm quiet time is observed on all properties. Please refrain from public display of drinking alcohol while on the property, no open alcohol containers are allowed in public areas in Red Lodge MT at all. The property management company has the prerogative to terminate this agreement and to ask the disruptive guest(s) to IMMEDIATELY vacate the property with the complete forfeiture of any and all monies paid. NO mobile sleeping units (i.e. travel trailers, motor homes, tents and/or other RV’s etc.) may be used at the property unless pre-arranged through Red Lodge Reservations. Be aware there is a fee to park, and use any mobile sleeping units at any property. Bringing an RV does not increase the occupancy at the units. Occupancy limits must be adhered to at every property.



FURNISHINGS, LINENS AND HOUSEWARES:

Please do not rearrange any furniture in the property, if furniture is found to be moved you will be charged a minimum fee of a $50, and $50 per hour after that to move the furniture/bedding, etc.… back in to its place. DO NOT move any furnishings outdoors. A basic supply of sheets and towels, hand soaps, shampoo, paper towel, facial tissue, and bathroom tissue are provided along with house wares. Additional items can be purchased at the local market. We suggest that you bring all personal items. Since the properties are privately owned, décor and equipment will vary. Property will be cleaned prior to arrival and after departure. Subsequent charges will be made to your credit card if extra cleaning services are required. No refunds will be made for appliances or heating/air conditioning failure.





SECURITY/DAMAGES AGREEMENT:

THE CREDIT CARD ON FILE WILL BE USED IN CASE OF DAMAGE OR ADDITIONAL CHARGES THAT EXCEED INSURANCE COVERAGE.

Registered guest(s) is/are individually and severally liable and otherwise fully responsible for any and all guest caused damages incurred to the property, including, but not limited to all adjacent structures and premises, throughout the entire duration of their stay of occupancy, whether intentional or accidental. The guest will have the option of selecting to choose to place a $1000.00 security deposit on their credit card, or guests may select a minimum amount of damage insurance. If damages from negligence or intentional damages occur that exceed the selected coverage, then reserve the right to change the credit card on file for any amounts due. We reserve the right to pull funds from the deposit, or travel insurance if any damages or missing items are found at the property. You will be given a detailed list of charges if your credit card is charged for any missing or damaged items. This includes, but is not limited to intentional and/or unintentional removal of property owner’s personal property, willful and/or accidental damage to structure(s) and premises including, but not expressly limited to any and all fixtures, appliances and furnishings. Guests’ credit card(s) shall be charged at full cost of repair and/or current replacement, including labor and materials, removal and disposal, plus taxes, as applicable. An itemized statement outlining all associated costs will be sent via email to the email address submitted by the guest(s) at such time as the reservation was booked. By signing this agreement, the guest(s) hereby agree(s) to pay for all such charges, as defined above and the proceeding pages. A one hundred dollar ($100.00) replacement fee shall be assessed to guest(s) that fail to return any and all property related keys. All such costs shall be charged to the guests’ credit card(s). Undue and/or unreasonable cleaning, due to guest misuse or excessive dirtiness of the property immediately subsequent to the guest’s departure shall be charged to the guests’ credit card(s) as a cleaning charge at a rate of fifty dollars ($50.00) per hour, with a one (1) hour service minimum. This applies to the premises, exterior, grounds and hot tubs/saunas/barbeques (if so equipped) as well as the premises interior. If hot tubs are mistreated by guests and maintenance has to drain, scrub and refill it you will be charged a minimum of $250.00, hot tub damages will be charged out accordingly for parts and labor. If hot tub is abused, we reserve the right to lock the hot tub and restrict further use. If temperatures drop below zero, the hot tub may be locked for guest and hot tub safety. All guests are responsible if there is an accident, drowning, or medical condition related to hot tub use during your stay. You are required to follow the state of Montana spa rules. No food or drink allowed in the hot tub. Weather conditions may cause snow and ice buildup around hot tub. We are not responsible for icy conditions located around the hot tub during your stay. If you rent a unit with a hot tub, you do so at your own risk and accept total liability when signing this agreement. PLEASE BE VIGILANT WHEN CHILDREN ARE IN OR AROUND THE HOT TUB. DO NOT LEAVE CHILDREN UNATTENDED AROUND HOT TUB. All guests are expected to examine the property structures and premises to the best of their reasonable ability UPON ARRIVAL, and to immediately report any and all damage(s) observed to the property management company.

DAMAGE INSURANCE: As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy www.vacationrentalinsurance.com/g20vrd. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Lazy M Property Management any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Lazy M Property Management directly if you do not wish to participate in this assignment.

CHECK-IN/CHECK-OUT PROCEDURES:

CHECK-IN time is 4:00 PM on the day that your scheduled reservation begins. Please try to schedule your arrival at your vacation rental accordingly, as there is NO early check-ins except by prior arrangements. CHECK-OUT time is 10:00 AM (SHARP). Unscheduled late check-out will be billed at $50.00 per hour as our staff is waiting to complete their job. Your cooperation in adhering to our established check-out time will be greatly appreciated by both our housekeeping staff and incoming guests. All dirty dishes, cookware and eating utensils should be washed, rinsed, dried and put away in the proper location and all trash shall be places in the proper receptical. Upon departure, we ask that you start the dishwasher and lock the doors. Please put the keys back in the lock box. Staff will be by to check that the property is secure at 10am.



If you lock yourself out during your stay please contact Red Lodge Reservations on call staff at 1-406-855-6485 to come unlock your door for you, please do not break into your rental. All after hours calls for unlock services will result in a $25 charge that will be charged to the card on file. Our office hours are Monday through Friday 9am to 5pm. All hours outside of these times are considered after hours.



HOME MAINTENANCE/HOLD HARMLESS:

Inconveniences under which we may have no immediate control and which DO NOT warrant any refund of rental monies include: (1) breakdown of VCR’s/DVD’s, hot tubs, saunas and/or other recreational appliances/devices, (2) power outages, (3) adverse road and/or weather conditions, (4) construction taking place in the area, (5) vacation home(s) that is/are not decorated and/or otherwise accommodated to suit the guest’s individual/personal taste(s), etc. Guests are solely responsible for any property damage, accidents or injury to any person or loss sustained by any person including personal property, in any way related to the guest’s use of the premises or items provided. Guest’s herby agree to indemnify Red Lodge Reservations and/or homeowners harmless from any and all claims, including those from third parties arising out of, or any way related to guest use of premises or items provided therein. Guest assumes the risk of injury or other losses related to any recreation activities and will hold owner and its agents harmless with respect thereto. We so not guarantee homes to be free of allergens. In case of an emergency, use the house phone provided to call 911.



SMOKING/PETS:

All properties are considered smoke free. Smoking is permitted OUTSIDE of the structures only as long as fire conditional allow. However, all cigar/cigarette butts, wrappers, and/or other material must be properly discarded. Materials found discarded about the grounds will necessitate additional cleaning, with a one (1) hour service minimum at $50, and $50 per hour after the first hour. Any extra cleaning charges including but not limited to carpet, furniture, draperies or bedding needed because of smoking will be charged to you credit card. Most properties DO NOT permit pets of any description. It is the guests’ responsibility to check with the property management company, prior to reserving, to disclose that they want to bring a pet(s) and to determine the availability of pet friendly properties. There is a daily pet fee per pet in pre-approved pet properties. If pets are found in properties that are not designated for pets shall result in the guests’ IMMDEDIATE eviction from the property and a non-approved pet fee of $75 will be charged per pet per day on the property and complete forfeiture of any and all monies paid, as well as additional cleaning costs. Pets found on any property that are not pre-approved by management held subject to the same pet rules and charges. Guests must remove all pet feces from the property. If maintenance or housekeeping has to pick up after your pet you will be charged a minimum of $50 and $50 per hour after that. Please do not leave any garbage outside of the property. Deposit garbage only in trash receptacles as there are many wild animals in the area. If personal property is found after a guest’s stay, Red Lodge Reservations will return personal property upon request with a handling fee of $25.00, plus all applicable shipping costs.



GUEST RENTAL AGREEMENT

Guest certifies that he/she has read and agrees to abide by the terms of this agreement and by accepting the e-signature you agree to these terms and conditions. The guest authorizes any outstanding charges remaining after departure to be charged to the credit card on the reservation.


ENTIRE AGREEMENT:

THIS AGREEMENT, WHEN COMBINED WITH ANY AND ALL COMMUNITY RULES AND REGULATIONS, (IF APPLICABLE) AND HOUSE RULES CONSTITUTES THE ENTIRE AGREEMENT. NO ADDITIONAL PROVISIONS ARE EXPRESSED NOR IMPLIED. THIS SUPERCEDES ANY AND ALL PREVIOUS AGREEMENTS, WHETHER ORAL OR WRITTEN, EXPRESSED OR IMPLIED. UPON E- SIGNING, THE GUEST(S)/CARDHOLDER(S) HEREBY
ENDORSE THE FACT THAT THEY HAVE READ AND UNDERSTAND THIS AGREEMENT IN ITS ENTIRETY, AND AGREE TO ACCEPT ALL OF ITS TERMS, CONDITIONS, AND RESTRICTIONS, WITHOUT EXCEPTION.
